THE BY LAWS OF THE
MIAMISBURG SPORTSMEN’S CLUB

MEMBERSHIP:
The membership level shall not exceed three hundred (350) fully paid Annual members.
An Annual member is defined as one who is a paid up member and has been in good standing for at least one year.
The dues shall be paid annually, and must be received by the Membership Director or his/her designee no later than the June membership meeting. Membership Renewal Letters will be mailed to all members between March 15 and April 1. Members are encouraged to remit completed renewal application and payment by mail as outlined in the membership renewal letter. All members must attend one of the annual safety briefings in order to receive their membership card and key. Two alternate days will be determined by the Membership Director to accommodate conflicting schedules that prohibit attendance at regular membership meetings. These will occur prior to the renewal deadline and will be outlined in the membership renewal letter. Any member that does not pay their renewal dues by the June membership meeting deadline will be removed from the roster. (Amendment approved 3/9/05)
All Annual, Associate and Junior members must be members of the National Rifle Association.
Associate members are defined as those persons living in the same household and legally related to the Annual member. Associate members shall pay dues at a reduced rate of $10.00. An Associate member enjoys the same rights, privileges and obligations as an Annual member.
Family members are defined as those persons living in the same household as an Annual member. A family member may attend club functions including formal or informal shooting events while in the company of a Probationary or Annual member. A family member does not have voting rights and does not pay dues.
Junior members are described as those persons between the ages of twelve (12) and seventeen (17). The annual dues for a junior membership is $10.00.
Probationary members are non voting members in their first year of membership. Probationary members may not sponsor new members or invite non-members other than family members to use the facilities.
Honorary and Special members are those that are selected by the Executive committee to be members. Nominations must be approved at a regular membership meeting.
Applicants for membership shall be recommended and introduced by a (1) current annual member at a regular membership meeting. The names of the candidates and their sponsors shall be posted on the club bulletin board as well as the sponsor’s telephone number.
The qualifications of the candidate will be reviewed at the next regular membership meeting. The candidate shall be accepted if a majority of the members present vote in the affirmative. The candidate may not be present during the review or the voting. Non members, probationary members, and other candidates must leave the room during a candidates review or vote. The candidate will be notified of the outcome before the next regular membership meeting.
New members accepted shall pay an initiation fee equal to one (1) years dues$75.00, plus one year’s dues (prorated by month), and a maintenance fee plus any special access fees and taxes. New members shall be required to serve on two work parties during their probationary period unless waived or deferred by the President. (Approved on 9/12/2007)
All members are required to wear their membership badges while on club property.
ELECTIONS:
Election of officers and trustees shall be held at the October meeting,
The President may not succeed him or her self more than (4) consecutive times. This is to be phased in starting in October 2005 with the Presidents eligibility ending in 2009. If a President is not re-elected the limit will start in the year the next person is elected to the office of President. (Approved 1/5/2005)
Nominations can be made from the floor or by a nominating committee.
Election of officers and trustees may be by secret ballot.
Officers shall be elected by a majority vote of members present.
Trustees shall be elected by the number of votes cast. Those candidates with the most votes will be elected to fill any openings until all trusteeships are filled. In the event of a tie, a run off election will be held.
The names of the officers and trustees shall be posted on the club bulletin board as well as their telephone number and or “E” mail address.
To be eligible for nomination or election, a candidate must be a fully paid up member who regularly attends membership meetings.
A candidate must be willing to serve and fulfill the requirements of the office, if elected.

ORGANIZATION:
The Executive Board is made up of all Officers.
The officers and trustees shall meet as a legislative and executive group at the discretion of the President.
Any officer or trustee may petition the President to call a meeting.
The President cannot make a motion or vote on any motion at a membership meeting unless said vote ends in a tie.
Any decision made by the executive board or board of trustees affecting the operation of the club shall be submitted to the membership for their approval at a regular or special membership meeting.
If any Officer or Trustee is not present for three (3) consecutive membership meetings without a reasonable excuse, they may be removed from office.
The offices of President and Treasurer shall be bonded to the amount determined by the board of Trustees. (Amendment approved on 5/11/05)
COMMITTEES:
The President shall appoint all committees. Committee Chairman can be appointed by the President or elected by the committee.
The standing committees shall be:
Trustees are expected to serve on committees. Committee members must be notified of committee meetings scheduled.
DISCIPLINE, SUSPENSION OR EXPULSION:
Any club member may be disciplined, suspended or expelled for conduct which is contrary to, or in violation of the Constitution or By-Laws of the club, or for obtaining membership in the club by giving false information, or disruptive conduct, or for flagrant safety violations or any other good cause as determined by the Ethics committee.
PROCEDURE:
Any annual member in good standing may file with the club Secretary a notarized complaint in writing against a member describing any act in violation that the accuser alleges to have occurred. The Secretary shall notify the President that a complaint has been filed. The President shall appoint a five member Ethics committee to evaluate the complaint. The President shall appoint a Chairman. The Ethics committee may dismiss the charges or direct that a hearing be conducted. The Secretary shall notify the complaining member of the findings of the Ethics committee. In the event that the Ethics committee directs that a hearing be conducted both the complaining member and the accused shall be notified in writing. The accused shall be furnished a copy of the complaint and the findings of the Ethics committee. The hearing time and location shall be mutually acceptable to all parties involved but must be held within 30 days of the ruling of the Ethics committee. At the hearing the complainant, the Miamisburg Sportsmen’s Club and the accused member may be represented by counsel. Testimony shall be under oath or affirmation. Both the complainant and the accused may present such evidence and witness as they determine is necessary. At the completion of the Hearing or hearings the Ethics committee shall hold separate meetings to determine the guilt or innocence of the accused and the degree of penalty that should be imposed. A three fifths (3/5) majority of the Ethics committee shall be required to find the accused guilty of the charge. The Ethics committee chairman shall notify the club President of their decision. The complaining member and the accused shall be notified by registered mail return receipt requested of the verdict of the Ethics committee. If the accused is found guilty as charged, the accused may appeal the decision of the Ethics committee to the general membership at a regularly scheduled membership meeting at which a quorum is present. At the membership meeting the complainant, the Miamisburg Sportsmen’s Club and the accused member may be represented by counsel. Testimony shall be under oath or affirmation. Both the complainant and the accused may present such evidence and witness as they determine is necessary. At the completion of the meeting a vote shall be taken by secret ballot. The Ethics committee chairman and a representative of each the accused and the complainant shall count the ballots. A simple majority shall be required to uphold the verdict of the Ethics committee. AMENDMENT:
Any proposal for amending these by-laws should be submitted in writing to the Recording Secretary at least ten days prior to the next membership meeting.
The proposed change should be read at two (2) consecutive membership meetings and be voted on at the second membership meeting.
A majority affirmative vote of the members present shall be necessary to adopt the proposed amendment.
An amendment that is adopted shall take effect immediately and be incorporated into these by-laws.
EMERGENCY AMENDMENT PROCEDURE:
An emergency may be declared. A motion to waive the second reading of a proposed change to the By-Laws must be made and seconded. A vote of the membership shall be taken by a show of hands. A 2/3 majority in favor of the motion shall be required for passage. (The Emergency procedure was approved at the membership meeting held on October 11, 2006)
GENERAL:
The club shall hold its regular membership meetings on the second Wednesday of each month at eight (8) pm.
The Roberts rules of Order shall govern all procedures.
No Officer, Trustee or Director shall receive a salary or other form of compensation, unless specifically authorized by the membership.
The President is authorized to spend up to $500.00 without prior authorization of the membership.
Officers and trustees shall be entitled to reimbursement for expenses incurred in behalf of the club.
Receipts must be furnished to receive reimbursements.
Upon the completion of eight four (48) hours of work, or two (2) work parties for the club, the member will be credited with an amount of money equal to the next year’s maintenance fee.
with an amount of money equal to $5025 ay but not more than $50 form the following years maintenance fee.
Members completing four (4) hours of work or one (1) work party may be eligible for a prize drawing to be held at the April June membership meeting.
CONTRACT FOR DIRECTORS OF ACTIVITIES:
Director:
A Director is a person appointed by the President who supervises an activity, event or a competition for the club. A Director shall fill out a Directors consent form and give full financial accounting as it pertains to the Miamisburg Sportsmen’s Club, and as directed by the club Treasurer. (Approved on 10/13/2004)
Each activity director shall report all money taken in to the Treasurer in the form of an annual report due o December 31 or as directed by the club Treasurer. The report shall show the number of competitors or club activity directed. All money taken in as well as expenses and money held in reserve for next competition or activity shall be reported.
A Match Director shall charge each member $3.50 for each club sanctioned event of match competition. Non members shall be charged $5.50. Competitors under the age of 18 shall not be charged. The money shall be collected by the Match Director or Secretary. These fees shall be paid to the club Treasurer at the completion of the tournament, event, program or shooting season. A report of the number of events and participants shall also be submitted. (Approved on 8/8/2007)

SEVERABILITY CLAUSE:
If any provision of these By-Laws is found to be invalid by a competent legal authority the remaining uncontested provisions shall remain in effect. The Officers and Trustees shall have the authority to substitute a provision which will meet the objections of the contested provisions.
